1. General information
1.1 Information on data protection

The Anonymous Whistleblower System is not the internal reporting office in accordance with the Whistleblower Protection Act (see also FAQ 5).
If you submit information via the contact form provided, your information from the enquiry form will be stored by us for the purpose of processing your request. Below is an overview of what happens to your personal data when you provide it. Personal data is any data that can be used to identify you personally. You are free to give up your anonymity at any time and contact us by stating your name and your contact details.
Your tip, regardless of whether you wish to remain anonymous, can lead to an investigation.
1.2 Personal data
The Anonymous Whistleblower System is designed to preserve your anonymity. Therefore, personal data is only collected by you providing it to us. From a technical point of view, no data is collected that allows conclusions to be drawn about your person.
If you use technical devices provided by your employer, metadata and your browsing history will be stored by your system administrator. This could allow conclusions to be drawn about your identity and jeopardize your anonymity. To protect anonymity, it is recommended that you do not provide any data that can be used to determine your identity. If you voluntarily provide personal data via a text field, you could be listed as a witness in criminal proceedings.
1.3 Postbox
You have the option of setting up a secured postbox in the whistleblower system with a username and password of your choice. In this way, you can send reports anonymously and securely to the responsible employee of the Berlin Police. With this system, the data is stored exclusively in the whistleblower system and is therefore particularly secure; it's not an ordinary email communication.
1.4 Sending attachments
When submitting a report, you have the option of sending attachments to the responsible employee of the Berlin Police. If you would like to submit a report anonymously, please note the following security advice:
Documents, images or other files may contain personal data that endangers your anonymity. Remove this data before sending. If you are unable to remove this data or are unsure, copy the text of your attachment to your message text or seek personal advice.
2. Mandatory information
2.1 Purpose and legal basis for the processing of personal data
The data is processed for the purposes of criminal prosecution, danger prevention, data protection control, civil service and disciplinary law and all other tasks assigned to the police (§ 1 ASOG in conjunction with §§ 158, 163 StPO).
The legal basis for the processing of the data results from § 483 et seq. of the Code of Criminal Procedure (StPO) and § 42 et seq. of the ASOG. For other information, the legal basis is § 3 of the Act on the Protection of Personal Data in the Berlin Administration (Berlin Data Protection Act – BlnDSG) in conjunction with Article 6 (1) (e) of the General Data Protection Regulation (DSGVO). After that, we are allowed to process the data necessary for the performance of a task incumbent on us.
2.2 Rights with regard to the processing of your personal data
You have the right to receive information about the origin, recipient and purpose of your stored personal data at any time, free of charge. You also have the right to request the correction or deletion of this data. If you have given consent to data processing, you can revoke this consent for the future. However, there is the possibility that a withdrawal of consent could only be possible to a limited extent due to police powers. You also have the right to request the restriction of the processing of your personal data in certain circumstances.
Furthermore, you have the right to lodge a complaint with the competent supervisory authority (see point 2.5). You can contact us at any time for this and other questions on the subject of data protection.

2.5 Supervisory authority
If you are of the opinion that data protection regulations are not being complied with when processing your data, you can lodge a complaint with the responsible supervisory authority (Art. 77 General Data Protection Regulation (DSGV). Persons concerned can submit their complaint to the authority of their place of residence, but in principle also to any other data protection supervisory authority.

2.6 Storage period
Personal data will remain with us until the purpose for which the data is processed no longer applies. If you assert a justified request for erasure or revoke consent to data processing, the data will be deleted, unless we have other legally permissible reasons for storing personal data (e.g. statutory retention periods). In the latter case, the deletion takes place after these reasons cease to apply.
We only share personal data that we process on our website with third parties if this is necessary for the fulfilment of the purposes and is covered by a legal basis or your consent. In addition, we pass on personal data to third parties in individual cases if this serves to assert, exercise or defend rights or legal claims. Possible recipients can then be, for example, law enforcement authorities, courts or other authorities involved.
